Carolyn Toto is a partner with the law firm's Intellectual Property practice and is located in the Los Angeles office. Her practice focuses on intellectual property litigation, prosecution and counseling in numerous areas, including the chemical, pharmaceutical and medical device industries. Ms. Toto represents clients in all aspects of intellectual property litigation, including jury trials and appeals.
Representative litigation matters include patent, trademark, trade secret and copyright infringement cases involving a variety of products and processes. The subject matter of Ms. Toto’s cases have included ink and toner compositions, hemostatic medical devices, oven rack sliding systems, computer memory modules, computer software, click-to-call technology, food dehydration processes and more. Ms. Toto is well versed in all aspects of litigation, including drafting pleadings, arguing motions, managing discovery, including participating in depositions and overseeing document review and production, working with experts to prepare reports, formulating litigation claims and/or strategy based on analysis of asserted patent(s) and accused product(s) and/or service(s), and participating in settlement negotiations.
In addition, Ms. Toto provides strategic intellectual property counseling to corporate clients, including that related to the prosecution, maintenance and development of extensive patent and trademark portfolios. Ms. Toto’s patent prosecution experience includes obtaining both U.S. and foreign protection in various technologies, including xerography, pharmacological compositions, gene therapy, and medical devices such as blood separation systems, insulin pumps, analyte monitoring systems, glucose sensors and vision corrective devices.
Ms. Toto counsels clients on a wide variety of other intellectual property related matters including licensing, research and development, due diligence in connection with mergers and acquisitions, patent infringement and validity analyses and freedom-to-operate opinions. Ms. Toto also counsels clients on legal issues involving social media and advertising, including those pertaining to content distribution through digital platforms.
Prior to starting her legal career, Ms. Toto worked as a research associate in the UCLA Nuclear Medicine Clinic where her daily research focused on basic nuclear instrumentation technology, molecular and medical pharmacology, and clinical nuclear medicine. Her research focused on the accuracy of positron emission tomography-imaging in the prognosis of Alzheimer's disease and other forms of dementia and developing a region-of-interest (ROI) software program used in evaluating potential brain dementia in patients.
