- Applications for Renewal of License: The three-year long license renewal cycles for broadcast stations in radio services (AM, FM, FM Translator), which began on June 1, 2011, and for television services (television, Class A, LPTV, TV Translator), which began on June 1, 2012, continue in 2013. The date on which a station's license renewal application is due depends on the state or territory in which its community of license is located. All licensees should familiarize themselves now with the dates associated with this important filing, including the dates on which public notice announcements must air in advance of the license renewal filing; the filing date itself, which is approximately four months before the date of license expiration; and the dates on which post-filing announcements must air.

With the unprecedented popularity of social media, employees have increasingly used LinkedIn and other online forums to network for business and social purposes. When the line between personal and business use is blurred, litigation may ensue. A federal court recently ruled that an employer did not violate federal computer hacking laws by accessing and altering its recently departed CEO’s LinkedIn account, but that the former CEO could proceed to trial on her state law misappropriation claim. In addition, California, Illinois, and Massachusetts recently joined Maryland in enacting laws prohibiting the practice of requesting access to prospective employees’ password-protected social media accounts.

Employ Me, Don’t Friend Me: Privacy in the Age of Facebook

With the unprecedented popularity of social media, individuals have increasingly been willing accomplices in undermining their own privacy. Few would have predicted that millions of people would voluntarily log onto the Internet and share detailed private information about themselves, their friends, family and employers. Users of social media have implemented varying privacy safeguards from unrestricted blogs to Facebook posts limited to a customized list of friends. Even those who seek privacy, however, must contend with a growing practice by employers and others of requesting access to password-protected social media accounts. Social media users have lost jobs and educational opportunities as a result of the increased scrutiny of these private postings. Maryland recently became the first state to enact a law prohibiting this practice; several other states and the U.S. Senate and House have similar legislation under review.

Introduction
Ten years after adoption of the Bipartisan Campaign Reform Act (“BCRA”) of 2002, popularly known as “McCain-Feingold,” Congress’ and the FCC’s interest in political broadcasting and political advertising practices remains undiminished. Broadcast stations must ensure that a broad range of federal mandates are met, providing “equal opportunities” to all candidates using the stations facilities, affording federal candidates for public office “reasonable access” and treating all candidates for public office no less favorably than the station treats its most favored advertisers. Accordingly, it is imperative that broadcasters be very familiar with what is expected of them in this regulatory area, that they have adequate policies and practices in place to ensure full compliance, and that they remain vigilant to legislative, FCC, and FEC changes in the law.

Supreme Court Settles Jurisdiction Question Under Telephone Consumer Protection Act

The U.S. Supreme Court has unanimously held that actions brought by private citizens under the Telephone Consumer Protection Act (TCPA) can be heard in either state or federal court, despite language in the statute which most appellate courts had previously interpreted as limiting such claims to state courts. In Mims v. Arrow Financial Services LLC, the Supreme Court resolved the circuit split, ruling that the language of the statute regarding state court jurisdiction is permissive, not mandatory, and insufficient to divest federal courts of jurisdiction over this federal law.

I. Applications for Renewal of License: The three year long license renewal cycle for broadcast stations in radio services (AM, FM, FM Translator) which began on June 1, 2011 continues in 2012. Licensees in the television services will begin the license renewal process in 2012, starting with television, Class A, LPTV, and TV translator stations located in Maryland, Virginia, West Virginia, and Washington, D.C., whose license renewal applications must be filed by June 1, 2012. The date on which a station's license renewal application is due depends on the state or territory in which its community of license is located. All licensees should familiarize themselves now with the dates associated with this important filing, including the dates on which public notice announcements must air in advance of the license renewal filing; the filing date itself, which is approximately four months before the date of license expiration; and the dates on which post-filing announcements must air.

In recent months, the owners of radio stations throughout the country have received letters from representatives of Mission Abstract Data, L.L.C., d/b/a DigiMedia (“MAD”), encouraging them to enter into patent license fee agreements with the company. MAD’s letter points out that it has sued some of the nation’s largest radio group owners. Undoubtedly, MAD will use the monies derived from the license fee agreements to help fund the current litigation as well as to demonstrate the “legitimacy” of its patent holdings. Consumer Suffered No Injury By Paying Tax on Retail Value of Discounted Cell Phone

California's Second District Court of Appeal, affirming the trial court's dismissal of Jessica Bower's class action complaint, concluded that Bower alleged "at the most a conjectural or hypothetical injury, not an injury in fact" by claiming she was deceived when she was told she had to pay the advertised sale price for a cell phone plus tax on the phone's retail value. The Bower decision helps define when a consumer has alleged an injury under California's consumer protection statutes and confirms that Regulation 1585(b)(3)"reflects California's general policy imposing sales tax on the retailer and permitting the retailer to collect sales tax reimbursement from the consumer.”

US Supreme Court Gives Green Light to Class Action Waivers in Consumer Contracts

On April 27, 2011, the U.S. Supreme Court, ruling in a five-to-four decision, in AT&T Mobility LLC v. Concepcion et ux., held that California's Discover Bank rule—a rule that largely invalidated class action waivers in arbitration provisions in consumer contracts in California and other states following similar rules—is preempted by the Federal Arbitration Act because it "stands as an obstacle to the accomplishment and execution of the full purposes and objectives of Congress." The ruling clears the way for class arbitration waivers in consumer arbitration agreements within the FAA's scope.

As the FCC previously suspended such filings in non-rural areas, today's action effectively stops all new station and major modification filing activity in the service.

The Federal Communications Commission has released a Notice of Proposed Rulemaking (NPRM) seeking comment on the method it uses to predict whether a satellite television subscriber can receive the over the air signal of its local network affiliate. This predictive model determines in the first instance whether the subscriber is eligible to receive the imported signal of a distant network affiliate. The FCC is also inquiring into the appropriate methodology for making actual on-site measurements at the subscriber's location, which can be used to challenge the results of the predictive model. In enacting the Satellite Television Extension and Localism Act of 2010 (STELA), Congress directed the Commission to undertake this rulemaking inquiry and to complete it by November 2010. Accordingly, the comment timeframe is very brief.

According to the FCC, the purpose of the NOI is to take a “fresh look at the current rules to determine whether they promote the Commission’s goals of competition, localism and diversity.” The NOI is generally asking for comment regarding its policy goals and how to apply its specific media ownership rules in order to best achieve those goals. The Commission is planning on using the comments filed in this proceeding to help the agency formulate a subsequent formal Notice of Proposed Rulemaking. For the first time in years, the U.S. Patent and Trademark Office’s Trademark Trial and Appeal Board (“TTAB”) on June 11 issued a precedential decision sustaining an opposition based on a likelihood of trademark dilution. The decision (see http://ttabvue.uspto.gov/ttabvue/ttabvue-91166701-OPP-99.pdf) gives owners of well-known marks renewed hope of halting the unauthorized registration of similar marks without having to establish a likelihood of confusion. This rare outcome also illustrates the critical role that evidence—such as a well-designed consumer survey— plays in trademark dilution claims.
FCC Suspends Indefinitely New Low Power Television Filing Opportunity in Nonrural Areas, But Does Allow New Digital Companion Channel Filings as of July 26, 2010

The FCC's Media Bureau released a Public Notice today suspending indefinitely the FCC's previously announced filing opportunity for new digital low power television ("LPTV") and TV translator stations in "nonrural" areas that was scheduled to begin on July 26, 2010. The Commission had announced the opportunity to file for new digital LPTV stations one year ago. Applications for new digital LPTV stations in rural areas have been permitted since August 25, 2009. Applications for new digital LPTV stations to be located in nonrural areas were originally to be permitted as of January 25, 2010, but that date was delayed to July 26, 2010. The delay appeared to be related to the then-impending release of the FCC's National Broadband Plan ("NBP"), which ultimately cited the need to repurpose some television spectrum for wireless broadband. "Nonrural" areas were identified in an Appendix to the Public Notice originally announcing the filing opportunity, and are generally those areas within 75 miles of the top 100 television markets.

As we wrote in an April 8, 2010 Client Alert, the FCC revised its Ownership Report form for commercial stations, Form 323, and announced that the deadline for all commercial broadcasters to file the new Form 323 is July 8, 2010. U.S. Supreme Court Reminds Employers to Update E-Communication Privacy Policies

On June 17, the U.S. Supreme Court unanimously upheld the legality of the Ontario, California Police Department's audit of police Sgt. Jeff Quon’s text messages in his department-issued pager, in City of Ontario v. Quon. Declining to issue a broad holding on employee privacy rights in electronic communications, the Court decided the case on the narrow point that, even assuming that Quon had a reasonable expectation of privacy in his text messages, the search was reasonable because it was motivated by a legitimate work-related purpose and was not excessive in scope. Nonetheless, the opinion emphasized the importance of well-crafted employer privacy policies, noting that “employer policies concerning communications will of course shape the reasonable expectations of their employees, especially to the extent that such policies are clearly communicated.”

CARD Act Will Exempt Prepaid Phone Cards (Not Mobile Broadband/Internet Access)

Prepaid “cards, codes and other devices” redeemable solely for telephone services are exempt from a new federal law that goes into effect August 22, 2010. The long strange trip of the Satellite Television Extension and Localism Act ("STELA" for short) seems finally to be ending. After satellite carriers' ability to import distant broadcast signals into stations' local markets expired on December 31, 2009, Congress passed a number of short-term extensions of the predecessor law, SHVERA. The Senate passed three different versions of the bill since late 2009. The House, with a lightning fast voice vote, accepted the Senate's last version unchanged and sent the legislation to the White House for a signature from the President. The President is expected to sign the bill shortly.

- Biennial Ownership Report Filing Requirements for Commercial Stations: The biennial ownership filing requirement for commercial stations has been stayed indefinitely as of the date of this publication. This stay arose out of difficulties implementing a new version of FCC Form 323 for use by commercial stations, including Class A television stations. The stay does not affect the biennial ownership reporting requirements of noncommercial stations, the due dates for which are still tied to the anniversary date of the station’s license renewal application deadline (and which are noted in this calendar). When the FCC resolves its difficulties surrounding use of the new Form 323, commercial broadcast stations will be required to file a biennial ownership report on the new form with information that is current as of November 1, 2009. Broadcasters should be alert to the announcement by the FCC of the new due date.
FCC Suspends the Use of the New FCC Form 323 and Postpones the January 11, 2010 Deadline for Filing Biennial Ownership Reports by Commercial Broadcast Licensees

This afternoon, the Commission released an Order announcing that, due to technical difficulties, it was temporarily suspending the use of the new FCC Form 323 and, as a consequence, was postponing the January 11, 2010 deadline for the filing of Biennial Ownership Reports for commercial broadcast licensees. The Commission stated that it would announce the reactivation of the new form and the new filing deadline in a subsequent Public Notice. The Order states that the Commission “will temporarily suspend the ability to start a new biennial Form 323 during this interim suspension period but will allow filers to complete and file forms that they have already started should they wish to do so.” The Order also states that the new filing deadline will be at least 90 days from the date that the new form is made available for new biennial filings.

As previously reported, stations that have not yet completed construction or commenced operation of their final post-transition DTV facilities must continue the required general DTV Consumer Education Initiatives until they commence operation on their post-transition DTV facilities. Such stations will be required to file another FCC Form 388 by January 10, 2010, providing the Commission with the details of the DTV Consumer initiatives that they performed between October 1 and December 31, 2009.

FCC Gives Television Broadcast Industry Little Time to Defend Its Spectrum Allocation; Comment Deadline Is Set at December 21, 2009

Earlier this week, the FCC released a Public Notice seeking “specific data on the use of spectrum currently licensed to broadcast television stations.” According to the Public Notice, in other proceedings related to the FCC’s development of a National Broadband Plan some commenters “have expressed concern that the United States will not have spectrum sufficient to meet the demand for wireless broadband services in the near future and have urged the Commission to make available more spectrum for commercial uses.” In response, the Public Notice states that “the FCC is reviewing various spectrum bands to understand if all or a portion of the spectrum within these bands could be repurposed for wireless broadband services.”

On December 1, 2009, the FTC’s newly-revised Guides on Endorsements and Testimonials will become effective. Broadcasters, including their on-air talent, need to know when a claim is an endorsement/testimonial, what on-air disclosures may be required, and what their obligations are to ensure that claims are truthful and not misleading. These endorsement/testimonial-related issues can arise in a variety of contexts, including when station personnel voice commercials, prepare copy for advertisers, engage in banter regarding a product or service, serve as a spokesperson for an advertiser, or provide content to their station websites.

Annual DTV Ancillary/Supplementary Services Report for Commercial Digital Television Stations

All commercial and noncommercial educational digital television broadcast station licensees and permittees must file FCC Form 317 to report whether their stations provided ancillary or supplemental services at any time during the twelve-month period ending on the preceding September 30. The FCC Form 317 is due by December 1, 2009. Electronic filing of FCC Form 317 is mandatory. Paper versions will not be accepted for filing unless accompanied by an appropriate request for waiver.
Ninth Circuit Ruling Leads to Spike in Class Actions Over Text Messages from Retailers

In Satterfield v. Simon & Schuster, Inc., 569 F.3d 946 (9th Cir. 2009), the Ninth Circuit held that unsolicited text messages to mobile phones sent by a retailer may constitute a “call” in violation of the Telephone Consumer Protection Act (the “TCPA”). This decision has sparked an increase in consumer class actions filed against retailers who send advertisements to consumers by text message.
FCC Shifts Net Neutrality Debate into High Gear

Last week the FCC launched a Notice of Proposed Rulemaking (NPRM) proposing to adopt six “open Internet” rules that would bind all broadband access providers, including those providing mobile and satellite broadband services. If adopted, the rules could have pervasive and lasting effects in many industry sectors, including broadband, voice and video service providers, infrastructure, device, chipset and other component vendors, content publishers and distributors, software publishers, and application service providers.
FCC Announces Filing Freeze for FM Minor Change Applications and Allotment Petitions and Creates Filing Window for Noncommercial Educational FM New Station Construction Permits

The FCC issued two Public Notices today which, together: (1) impose a freeze on the filing of all FM commercial and noncommercial educational (“NCE”) minor change applications from 11:59 pm, November 25, 2009, through December 18, 2009; (2) impose a freeze, beginning today, October 16, 2009, through December 18, 2009, on any applications proposing to modify the reference coordinates of 67 vacant non-reserved FM Band allotments listed on Attachment A of the Public Notice (attached hereto), as well as on any petitions or counterproposals that propose a change in the channel, class, community, or reference coordinates of those allotments; and (3) create a filing window for applications for those 67 vacant FM allotments reserved for NCE use.

FCC Postpones November 1 Ownership Report Filing Deadline

As we wrote in an earlier Advisory, the FCC adopted an order in April 2009 revising FCC Form 323, its Ownership Report form for commercial stations. It also expanded the types of entities and licensees required to file Form 323, announcing that owners of all commercial AM, FM, TV, LPTV and Class A TV stations would need to file the new form by November 1, 2009. The FCC later suspended its existing biennial Ownership Report filing requirement for stations that were to have filed in June, August, or October of 2009, since those stations would have to file the new Form 323 by November 1, 2009 in any event.

On September 8, 2009, the Office of Foreign Assets Control ("OFAC") of the Department Treasury and the Bureau of Industry and Security ("BIS") of the Department of Commerce issued final rules in the Federal Register amending the Cuba Sanctions program and the Export Administration Regulations ("EAR") to increase the range of telecommunications services that can be provided between the United States and Cuba and exports and re-exports of items to implement those services, as well as authorizing related payments and travel. These are included in a larger set of rule changes implementing the President's April 13, 2009, directive to promote contact between family members and the flow of information between the two countries.

The long-running battle over royalties owed by webcasters—companies that broadcast music over the Internet—took several significant leaps towards conclusion last month with important developments both inside and outside of the courtroom. Spurred by the Webcaster Settlement Act of 2009, signed by President Obama on June 30, SoundExchange and webcasters entered into a total of five Congressionally blessed settlement agreements that are open to other webcasters and are binding on all copyright owners and performers. Additionally, decisions were announced in two appellate cases. Set forth below are summaries of the key terms and important deadlines.

Drawing the Line: A Guide to Avoiding Illegal Content for the On-Air Performer

As the sources of content available to the public proliferate, attracting and retaining an audience grows more challenging. A common strategy is to use provocative or “attention-getting” on-air elements to increase station awareness among media-saturated listeners and viewers. However, stations must be mindful of the numerous legal restrictions on content, particularly given that illegal on-air content can garner fines as high as $325,000 per violation. In addition, certain types of illegal on-air content can subject a broadcaster to civil and criminal liability, as well as loss of its license.

FCC Announces Filing ‘Windows’ for New Digital-Only LPTV, TV Translator Stations in Rural Areas (Beginning August 25, 2009) and Nationwide (Beginning January 25, 2010)

This week, the FCC issued a Public Notice announcing that it is finally lifting the freeze on the filing of new low power television (“LPTV”) and television translator stations. First, on August 25, 2009, the FCC will begin accepting applications for stations in “rural areas” for: (1) new digital-only LPTV and TV translator stations; (2) major changes to existing analog and digital LPTV and TV translator facilities; (3) and, in the case of current analog stations, for digital companion channels. “Rural areas” are defined as areas with antenna site coordinates that are located more than 75 miles from the reference coordinates of the largest 100 cities as defined by Nielsen Media Research and are listed in Appendix A of the Public Notice. Second, the Public Notice also announces that on January 25, 2010, the FCC will begin accepting the above-referenced three types of LPTV and television translator applications nationwide, without any geographic restrictions.
FCC Adopts New Regulations Allowing AM Broadcast Stations to Use FM Translator Stations For “Fill-in” Purposes

In respond to the National Association of Broadcasters’ July 14, 2006 Petition for Rule Making, and after a Notice of Proposed Rule Making Proceeding released on August 15, 2007, the FCC today released a Report and Order adopting the NAB’s proposal that AM stations be allowed to use FM translators to retransmit their AM service within their AM stations’ current coverage areas. The action was taken to “permit AM broadcasters to better serve their local communities and thus promote the Commission’s bedrock goals of localism, competition and diversity in the broadcast media.”

On March 13, 2009, and in response to the Congressional extension of the digital transition deadline from February 17 to June 12, 2009, the FCC released an R&O which, among other things, revised the rules associated with its requirements for DTV Consumer Education Initiatives. Those significant revisions, which became effective on April 1, 2009, included additional viewer notifications regarding antennas, help/walk-in centers, rescanning activities, and service loss.
FCC Recommends That Viewers With DTV Reception Problems Try ‘Double Rescanning’ Their Digital Converter Box or Digital TV

The FCC issued a Public Notice recommending that viewers having difficulty receiving any of the over-the-air digital television signals of stations in their area should “double rescan” their digital converter boxes or digital television sets.
FCC Reminds TV Stations Transitioning on June 12 They Must Have Adequate Staff Available to Answer Viewer Phone Calls During the Cut-over and the Entire Weekend

In its Public Notice released earlier today, the FCC reminded stations of the requirement that television stations that have not yet made the transition to all-digital broadcasting must be prepared to answer calls about the transition immediately after they make the switch from analog to digital. The FCC noted its specific concern that stations have the appropriate staff available to answer calls after business hours and reminded stations that they should be prepared to handle the expected increase in calls, including calls forwarded directly to stations from the FCC’s National Call Center, which will be staffed 24 hours a day. The Public Notice specifically requests that stations not transitioning to digital-only until June 12 should not only staff their customer referral locations the evening of June 12, but should also ensure that the phones are staffed over the following weekend, June 13 and 14.
FCC Issues a Notice of Inquiry Seeking Public Comment Regarding Arbitron’s Use of Portable People Meters

The FCC’s Notice of Inquiry seeks answers to the controversial question raised by “broadcasters, media organizations and others” whether Arbitron is undercounting the audience for stations that air programming targeted to minority audiences, potentially harming the financial viability of those stations. At issue is Arbitron’s commercial use of equipment called the Portable People Meter (“PPM”), a mobile-phone-sized device that consumers wear throughout the day to track their radio listening. Arbitron has replaced the audience-based rating systems with PPM in certain markets and intends to replace audience-based diaries with PPM in the top 50 radio markets next year.

FCC Releases Revised List of Stations that are Eligible for Statutory Analog Nightlight Program

As previously reported, the Short-term Analog Flash and Emergency Readiness Act (the “Analog Nightlight Act”) required the FCC to develop a program to permit continued analog television service for 30 days after the DTV transition, thereby permitting stations to provide emergency and DTV transition information to the public in analog.

FCC Identifies Stations Which Must Undertake Additional DTV Transition-Related Information/Assistance Efforts in Order to Terminate Analog Service on February 17, 2009

Pursuant to the FCC’s February 5th Public Notice, “Procedures Regarding Termination of Analog Television Service On or After February 17, 2009,” any station wishing to early terminate analog operation was required to notify the FCC no later than February 9th. On February 10, the FCC released a list of the 491 stations that had filed this notification indicating their intent to terminate analog operations on February 17th. Yesterday evening, February 11th, the FCC announced that 123 of these stations will be required to undertake supplemental public interest initiatives in order to proceed with analog termination on February 17th. A copy of this list is attached.

Blizzard Wins Virtual World Battle Against MDY—CEO Found Personally Liable

On January 28, 2009, after the close of a bench trial, a U.S. District Court in Arizona found for Blizzard Entertainment and against its long time opponent MDY Industries. As we previously reported, the same court granted summary judgment in favor of Blizzard, finding that MDY was liable for copyright infringement, not simply for breach of contract, for distributing its flagship “Glider” product. This week, the court ruled for Blizzard on all three remaining issues: (1) Blizzard’s claims under the Digital Millennium Copyright Act (“DMCA”), (2) whether MDY’s CEO is personally liable to Blizzard, and (3) whether Blizzard is entitled to injunctive relief.
Options for Television Stations: Navigating the Uncertainty of a Delay in the DTV Transition Date

Legislation has been introduced in the United States Senate which, if enacted, would delay the current February 17, 2009 DTV transition deadline for a period of four months, or until June 12, 2009. A delay in the transition date will inevitably cause uncertainty and raise many questions, such as whether a station’s decision to cease analog operations before the proposed deadline may still go forward as planned.
Enforcement Monitor: FCC Finds Six Broadcasters Apparently Liable for Violations of Equal Employment Opportunity Rule

In late December 2008, the Federal Communications Commission (“FCC”) released a series of six Notices of Apparent Liability for Forfeiture against broadcasters asserting violations of the FCC’s Equal Employment Opportunity rule (“EEO rule”). In a joint statement appended to each of the six cases, FCC Commissioners Michael J. Copps (now Acting FCC Chairman) and Jonathan S. Adelstein (the “Commissioners”) signaled their strong desire that enforcement of EEO matters be stepped up by the Commission. The Commissioners noted that “Commission enforcement of EEO rules has been inconsistent and, as one consequence, employment in broadcasting does not reflect America.” Specifically, the Commissioners noted that while 251 cases resulted in 86 forfeitures between 1994 and 1997, only 10 cases resulting in 8 forfeitures were released between 2004 and 2007.

The following deadlines are based on information known by us as of the date hereof, may or may not apply to a particular broadcaster, are for general informational purposes only, and should be double-checked for currency close to each pertinent date/deadline. Actions by the FCC, Congress, or the courts could affect any of these deadlines by, for example, eliminating a particular reporting/filing obligation altogether or modifying the form used, content, deadline, fee, or manner of reporting/filing, such as requiring the posting of a report on the Internet or filing a report with the FCC electronically. It should also be noted that any FCC filing date which falls on a weekend or federal holiday, as a general rule, causes the filing deadline to be shifted to the immediately following business day. Furthermore, the listing of deadlines is not intended to be complete or exhaustive of all regulatory and non-regulatory deadlines that may apply to a given broadcaster year-to-year. Accordingly, broadcasters should seek the advice of communications counsel in each instance to assure timely and proper filing. This edition of our annual "Broadcasters' Calendar" supercedes all prior editions and accordingly any prior editions should no longer be used.

On December 23, 2008, the Federal Communications Commission (“FCC”) issued a Notice of Proposed Rulemaking (“NPRM”) proposing creation of a new replacement digital television translator service. This service will permit full-power television stations to continue to provide service to viewers who have lost or will lose service as a result of a station’s digital transition. In the NPRM, the FCC announced that it will begin accepting applications in the coming days, although processing of these applications will be withheld pending the outcome of the proceeding. In the interim, the FCC proposed that stations could request Special Temporary Authority (“STA”) to operate replacement television translator facilities during the pendency of the rulemaking proceeding.
FCC Issues Notice of Proposed Rulemaking for Analog Nightlight Program

On December 24, 2008, the Federal Communications Commission (“FCC”) issued a Notice of Proposed Rulemaking (NPRM) to implement the recently enacted Short-Term Analog Flash and Emergency Readiness (SAFER) Act. The SAFER Act directs the Commission to develop a “nightlight” program to permit stations to continue to broadcast analog signals for 30 days after the February 17, 2009 DTV transition deadline for the limited purpose of providing public safety and digital television (“DTV”) transition information. The Notice describes the FCC’s framework for implementing the nightlight program and establishes an expedited public comment period. The notice was published in the Federal Register on December 31, 2008, thereby establishing Monday, January 5, 2009 as the deadline for comments, and Thursday, January 8 as the deadline for reply comments.

On December 23, 2008, the President signed into law the Short-Term Analog Flash and Emergency Readiness (SAFER) Act. This legislation, previously passed by the House of Representatives on Dec. 10, 2008 and by the Senate on Nov. 20, 2008, directs the Federal Communications Commission (“FCC”) to develop a program to permit analog broadcasts of public safety and digital television (“DTV”) transition information for 30 days after the February 17, 2009 DTV transition deadline. Accordingly, stations must await action by the FCC before this post-February 17, 2009 authority will be effective.

FCC Universal Service Fund Proceeding Expected to Impact Telecom Charges for End Users; New Reply Comment Date Established

On December 2, 2008, the FCC extended the reply comment date in its sweeping Universal Service Fund (“USF”) Further Notice of Proposed Rulemaking (the “FNPRM”) until December 22, 2008. USF is an almost $7 billion program overseen by the FCC that promotes the availability of affordable telecommunications services throughout the United States. Funds are made available to schools and libraries, low-income residential consumers and telephone companies operating in high cost areas.

Congress Gives SoundExchange and Webcasters Authority to Settle Royalty Rates

On September 30, the U.S. Senate approved the Webcaster Settlement Act of 2008, a bill giving SoundExchange and webcasters authority to finalize an agreement on performance royalty rates. The bill amends section 114 of the Copyright Act to give SoundExchange until February 15, 2009, to reach a deal over the statutory royalties owed by Internet radio stations, and other non-interactive online music services, to performers and sound recording copyright owners (generally record labels) when their music is performed publicly by means of a digital transmission. The legislation, which was passed by the House of Representatives on September 27, is expected to be signed into law by President Bush.

In a significant victory for publishers in their long-running battle with freelancers, a federal appeals court in Atlanta recently ruled that magazine publishers do not have to compensate the individual copyright holders of freelanced articles and photographs when the magazines are reproduced on CD-ROM for commercial sale, unless contracts between the publisher and the freelancer provide to the contrary.
Upcoming Deadlines Relating to Cable and Satellite Carriage of Television Stations

July 31, 2008 is the deadline by which television stations are required to file claims for copyright royalties with the Copyright Office. FCC rules require television stations to make signal carriage elections by October 1, 2008 for the period 2009-2012. The upcoming termination of analog broadcasts makes this year’s carriage elections especially important. In addition, television stations that will terminate analog broadcasting have a special October 1 notice obligation with respect to satellite operators.

Unlicensed But Not Unregulated: An Overview of the FCC's Regulations Regarding Part 15 Devices

The FCC has long permitted devices employing relatively low level radio frequency signals (“Part 15 devices”), such as garage door openers, cordless telephones, personal computers, and computer peripherals, to be operated without the need for a spectrum license. While such operations are unlicensed, the devices themselves are not unregulated. The FCC’s rules require that the manufacturer or importer of such devices (the “responsible party”) obtain equipment authorization before marketing any such device in order to minimize the potential for harmful radiofrequency interference. For Immediate Attention
As we have previously advised, on March 3, the FCC released a Report and Order outlining new requirements imposed on full-power television stations for educating consumers about the February 17, 2009 transition to digital television service. On March 28, the FCC released a Public Notice announcing that it had received the necessary approvals from the OMB and that the new rules, including reporting requirements, would become effective on Monday, March 31, 2008. As a result of that announcement, full-power television stations must file with the FCC their first FCC Form 388 quarterly report by April 10, 2008. FCC Requires Cable Systems to Format Must-Carry Signals to Ensure "Viewability" on Both Analog and Digital Televisions After the Termination of Analog Broadcasts in 2009
At a late-night meeting on September 11, 2007, the Federal Communications Commission (“FCC”) adopted a “viewability” rule that will govern cable carriage of must-carry stations after analog broadcasting terminates in 2009. The rule requires cable operators to deliver the primary digital stream of a must-carry television station in a manner that will permit it to be viewed by all cable subscribers after the transition to digital television occurs on February 17, 2009. Specifically, cable operators will be required to carry the primary digital stream of a must-carry station, and will be required to either provide the digital signal in analog format as well, or carry the signal only in digital format, but ensure that

On May 31 the Federal Communications Commission (FCC) released an order detailing its new rules for in-band on-channel (IBOC) digital broadcasting by AM and FM radio station licensees. Stations currently providing digital IBOC signals have been operating under interim rules. The new rules impose a relatively light regulatory touch, reflecting the FCC’s belief that broadcasters should have broad flexibility to experiment with new service models and to tailor their service offerings to market demands.

New Version of FCC Form 398 for First Quarter Children's Television Programming Reports Now Available
The newly revised FCC Form 398 is now available on the FCC’s website. The completed form should be filed with the FCC no later than between June 1 – 10, 2007, covering the period January 1 – March 31, 2007. The FCC had previously postponed the filing deadline for the first 2007 calendar quarter Children’s Television Programming Reports due to the delay in revising and obtaining clearance for this newly revised form.

Interpretational difficulties abound with respect to certain provisions of the Sarbanes-Oxley Act of 2002 (“Act”). Pub. L. No. 107-204, 116 Stat. 745. The interpretation of Section 804 of the Act, 28 U.S.C. § 1658, has spawned a considerable amount of litigation in federal district courts. Section 804, entitled “Statute of Limitations for Securities Fraud,” lengthens the limitations period for certain private securities actions from one year after discovery of the facts constituting the violation to two years, and from three years after the violation to five years, whichever occurs first. See id. Federal district courts have addressed whether Section 804, subsection (b), which states that the limitations period “shall apply to all proceedings addressed by [Section 804] that are commenced on or after the date of enactment of [the Act],” applies retroactively and revives previously expired private securities actions. Federal appeals courts have yet to address this issue; however, as of the date of this LEGAL BACKGROUNDER, the U.S. Court of Appeals for the Second Circuit has a case pending in which the interpretation of Section 804 is at issue. See AIG Asian Infrastructure Fund, L.P. v. Chase Manhattan Ltd., No. 04-2403 (2d Cir.). To date, the majority of courts have decided that Section 804 does not revive previously expired private securities actions. However, the Securities and Exchange Commission (“SEC”), in an amicus curiae brief filed in the Second Circuit,1 has concluded the contrary, as have some courts. This LEGAL BACKGROUNDER summarizes and examines the arguments for and against the proposition that Section 804 revives time-barred private securities action.
