Former Rep. Jerry McNerney, who is now a Senior Policy Adviser at Pillsbury, told Corporate Counsel that open-source AI models can be a great opportunity for startups to avoid paying big money for proprietary software that might not match their needs, while also eliminating the need to create something completely new from the ground up.  But, it can also come with risks for companies using it.

Criminals can find vulnerabilities, exploit them and turn them against companies that have adopted open-source AI, McNerney said. “If [criminals] can get into back-doors, they can cause all kinds of problems. They can cause problems for a business or government.”

McNerney added that the currently regulatory landscape for open-source AI is less like a well-trod path and more like the Wild West.

“There's going to be a lot of case law decided in the next decade, based on what courts decide and how far lawsuits go up the court system,” McNerney said. “This is going to be an interesting period, and it's going have a lot of legal opportunities, and a lot of legal pitfalls. Buckle up and be cautious!”
