Artificial intelligence may reduce medical errors, but its use in health care raises liability concerns and potential medical malpractice risks, according to a recent article in Business Insurance.

Insurance Recovery & Advisory counsel Aaron Coombs told Business Insurance that there is a risk of a medical malpractice claim if providers move forward with using AI tools and the AI produces false information.

“Physicians or nurses could be held liable if there’s a misdiagnosis that results in bodily injury to a patient as a result of them using technology to aid the decision,” he said. As other parties and lines of coverage could apply, Coombs noted that AI or technology service providers may be “on the hook for providing services that don’t work properly.”
