The DMCA creates a safe harbor for an OSP that follows prescribed guidelines for blocking access to allegedly infringing material after receiving proper notification of a copyright infringement claim (a “takedown” notice). Although more than 15 years have passed since the law took effect, questions and controversies surround the proper use and/or the abuse of the DMCA takedown process. The panel will explore those issues from both the copyright holder and the OSP perspective, and will include a discussion of recent developments in the DMCA-related cases pending in the Ninth Circuit (Lenz v. Universal Music Corp.) and the Second Circuit (Capitol Records, LLC v. Vimeo, LLC).
