IP Partner Jim Gatto Explains Patent Wars for FOX Business Network

Pillsbury Intellectual Property partner James G. Gatto appeared on FOX Business to break down interrelated business and legal issues behind escalating "patent wars" in the technology sector, where high-profile patent acquisitions and IP litigation between major industry players are on the rise.

"When you look at what is happening, there are many levels at which this war is being waged," Gatto explained. "You have a war for the operating systems, a war for devices and then you have a war for the overall business models. This is all going on with the existing players, and part of what this war will do is prevent others from coming in to the market by just copying what is going on."

"What this is doing is raising the bar, and if you want to be a new entrant in this field, you're going to have to innovate, you're going to have to come up with something that is better than what is out there, or you’re going to get sucked up in these patent wars and really get knocked out before you’re even out of the box."

"The companies that have spent money innovating and protecting their IP over the years and investing are reaping the rewards and those that are out there without patents ... have to go out and open their coffers [to acquire patents]."
