    Kim Buffington is a trial lawyer with significant experience in business and commercial litigation, intellectual property matters, and insurance coverage disputes. She handles arbitrations, appeals, class actions, trials, and all facets of litigation and alternative dispute resolution. Generally, her litigation and appellate experience includes the following:

    • Successfully tried a Uniform Commercial Code business dispute for four weeks in federal court.  
    • Successfully defended a client in a state court criminal trial. 
    • Secured a multi-million dollar recovery as contract damages following a six-week arbitration in New York.
    • Successfully argued, briefed, and advocated for a state appellate court to uphold a trial court's dismissal of a case. 
    • Prepared winning appellate briefs submitted to the Ninth Circuit Court of Appeals and the California Court of Appeal.
    • Conducted live jury research exercises. 
    • Defeated class certification in employment contract matters.
    • Conducted and defended many depositions and witness interviews. 
    • Obtained temporary restraining orders, preliminary injunctions, and discovery orders. 
    • Prepared numerous matters for trial by drafting witness and exhibit lists, preparing witnesses for direct and cross-examination, drafting and arguing jury instructions, and outlining opening and closing arguments. 
    • Managed litigation matters from initiation through trial, including outlining case strategies; guiding clients through pre-litigation negotiations and early assessment of the case for ADR; implementing discovery plans; handling dispositive motions; preparing experts; conducting trials and arbitrations; and handling appeals. 

    Ms. Buffington has significant experience in entertainment and intellectual property litigation, including extensive experience handling copyright and trademark matters, claims for misappropriation of name and likeness, disputes concerning privacy rights, celebrity imitation and stalking issues, and cases involving licensing disputes. She has represented recording artists, entertainment conglomerates, digital media companies, and radio stations.  In addition to her general litigation skills, Ms. Buffington's intellectual property experience includes the following:

    • Conducted a two week trial in federal court involving copyright claims that ultimately settled at the close of trial. 
    • Settled various copyright and trademark infringement claims for nuisance value. 
    • Obtained temporary restraining orders, preliminary injunctions, and discovery orders. 
    • Negotiated and drafted several settlement agreements and related intellectual property licensing agreements.

    Ms. Buffington has substantial experience handling insurance coverage disputes for policyholders and has recovered over $35 million for policyholder clients. Her insurance coverage practice encompasses claims arising out of: employment related class actions, construction litigation, complex environmental matters, digital media cases, copyright infringement suits, business interruption losses, disputes over directors and officers, errors and omissions, and fiduciary liability policies. A few examples of Ms. Buffington's representative insurance coverage matters include the following:

    • Mediated and obtained a multi-million dollar recovery for a fast food chain following the insurance carrier's wrongful denial of coverage for a wage and hour class action.
    • Obtained a favorable arbitration award for a fast food chain following the insurance carrier's wrongful denial of coverage for a wage and hour class action.
    • Obtained a multi-million dollar arbitration award to recover an insured's portion of the settlement proceeds paid by the carrier to a co-insured.
    • Favorably settled multi-million dollar environmental liability claims after a decade of litigation.

    Ms. Buffington co-heads the Los Angeles Summer Associate Program and serves on the firm's Hiring and Pro Bono Committees.
