Commercial Bribery in China

As mentioned in: Financial Fraud Law Report
February 2012
The recent death sentence imposed on the former president of Shanghai Pharmaceutical Group reminds the market that China is serious about its crackdown on corruption. Although these types of sentences are often commuted to life in prison, the sentence is a reminder of how seriously Beijing takes the question of corruption in what is now the world's second largest economy.

This case involved an official of a state-owned company and violations of criminal law. China also prohibits bribery in the purely commercial context, and these laws are a subject of real importance for every company investing in or doing business with China. This article, written by Thomas Shoesmith, the head of Pillsbury's China practice, focuses on commercial, as opposed to government-oriented, corruption.
