The U.S. Court of Appeals for the D.C. Circuit ordered the Environmental Protection Agency to revisit its emission standards for sewage sludge incinerators. The Sierra Club and the National Association of Clean Water Agencies (NACWA) had petitioned the EPA to reconsider the standards after they were published in 2011. Both petitions were denied, leading to an instant appeal.

Washington, D.C.-based environmental partners Peter Wyckoff and Jeffrey Knight represented the NACWA.

As the Court found that both NACWA’s and EPA’s readings are permissible under the statute, confirming that the EPA has the authority to correct the problems this rule creates for municipalities around the country, Knight commented, “These local clean water agencies rely on incineration as a safe and responsible way to manage biosolids, so we are pleased to have another opportunity to work with EPA to get this rule right.”
