Fast food company Jack in the Box filed suit this week against National Union Fire Insurance Co. for its refusal to pay part of a $20 million judgment to a man who suffered life-threatening injuries from being beaten in the parking lot at one of its St. Louis restaurants.

According to Law360, Jack in the Box alleges that National Union, an AIG company, violated its commitment to pay prejudgment interest as indicated in its policy. Jack in the Box pointed to a $46 million damages verdict against National Union in August, a case in which Pillsbury represented the plaintiff, as evidence of the insurer’s pattern of this behavior. The fast food chain is seeking $1 million in compensatory damages, in addition to punitive damages.
