Insurers and policyholders will spend much of 2013 brawling over who should foot the multibillion-dollar bill for Hurricane Sandy losses, while attorneys also expect a hotbed of litigation over cyber-liability claims, including more infighting among carriers.

There is sure to be a wave of coverage litigation over Hurricane Sandy in 2013, partly because the New York area hasn't witnessed a storm of that scale in recent memory, according to James Bobotek, counsel in Pillsbury’s insurance recovery and advisory practice in Washington, D.C. and Northern Virginia.

"There's just been no reason to litigate a lot of these property policy issues in New York and its surrounding states," he said.

Bobotek also expects more litigation surrounding cyber-liability insurance in 2013, whether it's lawsuits over coverage under the fairly new types of policies or fights between insurers that could be on the hook.

“There's going to be some insurer v. insurer arguments over who ultimately has to pay the indemnity,” he predicted. “I see a lot of equitable contribution claims.”
