Kevin Fong, head of Pillsbury’s appellate litigation practice and based in San Francisco, spoke to Law360 about his litigation experience and lessons he has learned during his career.

When asked what the most challenging case he has worked on was, Fong said writing an amicus brief for In re Marriage Cases, a 2008 decision by the California Supreme Court overturning the state’s statutory ban on same-sex marriages. “The challenge was to craft an amicus brief seamlessly combining everything — the history and its relevance, the legal underpinning and the personal stories of Asian American same-sex couples. A further challenge was coming up with a brief that ultimately would be joined by more than 60 diverse Asian American community organizations.”

Fong added that he wished he had done more jury trials early in his career. “It’s a great way for an appellate lawyer to appreciate how hard it is to try a case!”
