Nuclear power producer Entergy Gulf States has been awarded an additional $5.2 million in spent nuclear fuel storage costs by the U.S. Court of Federal Claims, Law360 reports. Entergy sued the U.S. Department of Energy more than a decade ago to recover monetary damages that the company alleged resulted from the DOE’s delay in receiving used nuclear fuel from one of its power plants in Louisiana. Last year, Entergy was awarded $42.3 million in damages related to the storage of that fuel. But the court left open Entergy’s claim that it also was owed for the cost of loading the spent fuel into storage containers until the Federal Circuit ruled in April that another Entergy unit, System Fuels Inc., was owed damages from the DOE for the same costs.

The additional $5.2 million award includes nearly $8,000 in allegedly unsupported costs and more than $46,000 in payroll costs. Entergy is represented by Government Contracts & Disputes partner Alex Tomaszczuk, Nuclear Energy partner Jay Silberg and Litigation associate Clare Pincoski.
