Roxane Polidora is the firmwide leader of the law firm’s Antitrust & Competition practice and is located in the San Francisco office. She is also the past Chair of the State Bar of California's Antitrust and Unfair Competition Law Section.

Ms. Polidora handles significant antitrust, unfair competition, and commercial litigation in California state courts and federal courts across the country. Ms. Polidora has tried cases before juries, judges, and administrative tribunals. She has extensive experience handling antitrust and unfair competition class action lawsuits, including complex multi-district litigation. She also has significant experience handling district attorney and state attorney general antitrust and unfair competition investigations and litigation.

Throughout her career, Ms. Polidora has handled litigation matters for corporate clients in a wide variety of industries, including oil and gas and other energy sectors, health care, telecommunications, electronics, retail, hospitality, technology, banking and manufacturing. The claims alleged in these cases encompass antitrust, unfair competition, fraud, business torts, consumer protection statutes, including consumer class actions relating to the recording of telephone calls, false advertising and trade secrets violations.

Significant trials handled by Ms. Polidora include: a three-month federal jury trial involving an alleged antitrust conspiracy to allocate geographic markets in the oil industry; a fraud and political misconduct jury trial; and a bribery and fraud court trial. Ms. Polidora participated in a significant antitrust and theft of technology case that resulted in a seminal appellate decision. Ms. Polidora tried numerous criminal cases while “on loan” from the firm as a Deputy District Attorney in Santa Clara County. Prior to joining the firm, Ms. Polidora tried federal court criminal trials for the U. S. Attorney’s Office in the Northern District of California, Criminal Division.

Representative Matters
  • federal antitrust litigation alleging group boycott involving big box retailer and various suppliers; obtained dismissal of case on pleadings; complaint amended and litigation ongoing;
  • federal and state court class action litigation alleging RICO and unfair competition claims involving the telecommunications industry; obtained favorable nationwide class action settlement which is pending final approval;
  • obtained dismissal of horizontal conspiracy allegations and denial of class certification in federal court antitrust class action litigation involving alleged conspiracy among commercial natural gas marketers and pipelines;
  • lead counsel for a manufacturer in investigation by California Attorney General’s Office regarding alleged resale price maintenance in violation of Cartwright Act; obtained favorable settlement;
  • antitrust price-fixing direct and indirect purchaser class action lawsuits in federal multi-district litigation and state court proceedings involving electronics manufacturers (obtained dismissal), plastic additives (obtained favorable nominal settlement), shipping (defeated antitrust claims and settled for nominal amount), oil and gas (see successful jury trial above) and other industries;
  • antitrust and unfair competition advice and counsel to electronic manufacturers, energy companies, title companies, retailers, educational institutions and college athletic conference;
  • numerous unfair competition class actions and private and public attorney general lawsuits throughout California involving retailers, hotels and other industries; defeated claims and achieved favorable resolutions;
  • national counsel in federal multi-district and state court antitrust and fraud litigation involving consumers, insurers, pharmacies, and pharmaceutical manufacturers alleging $8 billion in damages; after litigation of key issues, obtained favorable nationwide settlement with all parties;
  • lead counsel in California state court coordinated proceedings involving price-fixing conspiracy allegations against manufacturers of commercial paper;
  • state court commercial litigation involving claims against a software company for fraud and breaches of contract and fiduciary duties;
  • national counsel for a pharmacy chain in products liability class action litigation; and
  • arbitration before the International Centre for Dispute Resolution involving an agreement to resell software in Europe.
