The New 409A IRS Document Correction Program – How to Cure Your Deferred Compensation Plan 409A Violations

Violation of section 409A’s complex requirements for nonqualified deferred compensation arrangements imposes significant tax penalties on employees and reporting requirements on employers. Final section 409A regulations required all plan documents to be compliant by January 1, 2009. The IRS has recently issued Notice 2010-6 permitting plan documents to be amended to cure failures in plan language, with a special transition rule for 2010.
