The development of HIPAA Business Associate Agreement (BAA) forms and practices preceded the publication of the 2013 Omnibus Final Rule that implements HIHPAA and HITECH. Relationships between covered entities and their business associates, relationships among business associates, and the BAAs among them, must be updated to comply with the new rule. Potentially complicating that process, when negotiating BAAs, HIPAA covered entities frequently overreach by including topics unrelated to the business associate’s obligations under HIPAA and imposing unnecessarily complex and onerous terms.
