Max Winograd focuses his practice on all aspects of commercial litigation. 

Max has litigated and arbitrated matters with billions of dollars at stake, with a particular focus on international issues and clients. He has experience in contract, civil rights, mass tort, securities and antitrust-related litigation from inception through trial. He has regularly worked with clients in the financial services, education, aviation and technology industries.

Representative Experience

  • Defended university in federal Title IX litigation by respondent alleging gender discrimination, in connection with his dismissal after disciplinary proceeding. The District Court entered summary judgment for the university and plaintiff’s appeal is pending.
  • Representing former shareholders in an international arbitration arising from breach of a merger agreement.
  • Defending a foreign bank in federal court from several lawsuits arising under the Anti-Terrorism Act and Justice Against Sponsors of Terrorism Act.

  • Represented Epic Games in an antitrust action against Apple over its App Store and “In-App Purchase” policies.
  • Represented Credit Suisse in a series of securities actions brought by institutional investors in both state and federal court all over the country related to residential mortgaged-backed securities following the 2008 financial crisis.
  • Represented Pacific Gas & Electric Company in litigation arising from the North Bay Fires in California in 2017 and, subsequently, the biggest utility bankruptcy in U.S. history.
  • Represented 19 children in foster care in New York City in a lawsuit against the Commissioner of New York’s Office of Children and Family Services and the City of New York, a putative class action on behalf of all children who are or will be in foster care in New York City.
