In a recent article in the New York Law Journal, former Presiding Justice of the New York Supreme Court Appellate Division, First Department and Litigation partner Rolando Acosta and Michael Fernández discuss the need to reform the certification process from the Departments of the Appellate Division to the Court of Appeals and offer some specific proposals.

Specifically, the authors provide an overview of the current procedure for certification under CPLR 5602, the limitations of that system, some of the benefits of adopting a more liberal approach to certification to the Court of Appeals, and a legislative proposal to liberalize the existing certification procedure.
