On February 20, 2026, the U.S. Supreme Court ruled that IEEPA does not authorize the President to impose tariffs. This decision raises questions of what happens to the over $135 billion in IEEPA tariffs collected, what costs and obligations face importers following this decision, and what additional steps the Trump administration might take in response.
