A Texas federal judge ruled that Icon Health & Fitness Inc. infringed a Chinese patent held by Nautilus Inc., reports Law360. As part of the ruling, Nautilus won $1.8 million in damages resulting from the infringement and Icon’s failure to pay royalties under the licensing agreement.

Nautilus sued Icon in January 2016 for breach of a licensing agreement that included a 5 percent royalty on gross sales for ellipticals that used Nautilus’ patents. Icon later filed a counterclaim, and both companies filed summary judgement motions in March 2017. U.S. District Judge Royce Lambert ruled that after all of Nautilus’ patents expired in 2015 except the Chinese one, Icon had improperly withheld royalties for sales occurring prior to the expiration of the Chinese patent in January 2016.
