Christopher Kao, partner and leader of Pillsbury’s Intellectual Property Litigation practice, will examine how recent changes to United States Patent and Trademark Office (USPTO) post-grant proceedings, including inter partes review, post-grant review and covered business method challenges, affect patent litigation strategy before the Patent Trial and Appeal Board (PTAB) and in federal court. The discussion will cover petition timing, dual-track litigation, estoppel, and Federal Circuit doctrine, as well as recent changes to institution decisions and proposed mandatory-denial rules.
