Mike Zeliger, Pillsbury’s Global Head of Intellectual Property (IP), focuses his practice on complex patent litigation, as well as other IP and related technology litigation in state and federal courts throughout the United States, along with administrative bodies such as the International Trade Commission (ITC).

Mike has served as the lead counsel in over 100 IP litigation matters for numerous life sciences and technology companies, including those in the fields of medical device, diagnostics, medical safety equipment, reagents, therapeutic devices, laboratory instrumentation, infusion pumps, drug delivery agents, flow cytometry, fluorescence microscopy, platelet rich plasma, ultra-high molecular weight prosthetic implants, home security and automation, consumer products, vibration control systems, robotics, nonwoven materials, food processing and manufacturing. Mike has experience in all stages of litigation, including Markman and dispositive motions, jury and bench trials, and appeals.

Pharma, Life Sciences and Health Care

  • Defended MicroVention in a patent infringement lawsuit brought by Stryker Corp. in Delaware involving vascular stent technologies. Filed an ex parte reexamination request, resulting in a stay of the district court proceedings and cancellation of all challenged claims at the Patent Office. Stryker Corp. v. MicroVention, Inc. (D.   • Defended ViewRay in a patent infringement lawsuit brought by Varian Medical Systems in the Northern District of California involving radiotherapy technology. The case was stayed and eventually resolved after the Court found six claims indefinite during claim construction.     • Defended Tyco Healthcare (now Covidien) in a patent infringement lawsuit brought by Becton Dickinson involving actuatable safety shields for needles. We won a reversal upon appeal following the trial court’s judgment of infringement. Becton Dickinson Co., et al v. Tyco Healthcare (D.Del.).
    • Defended Sigma International in a patent infringement lawsuit filed by CareFusion 303 involving infusion pumps. We prevailed in an eight-day trial in which we secured a judgment of non-infringement. CareFusion 303, Inc. v. Sigma International (S.D.Cal.).
    • Represented Dako Denmark in a patent matter involving slide-based cellular diagnostics. We obtained a favorable settlement immediately following a favorable Markman hearing. Dako Denmark A/S v. Ventana Medical Systems, Inc. (D. Ariz.).
    • Represented Dako Denmark in a patent infringement matter related to reagents for detecting prostate cancer. We obtained a dismissal of a district court action, followed by a favorable settlement of a corresponding arbitration. Dako Denmark A/S v. AsymmetRx, Inc. (D. Mass.).
    • Served as lead counsel for CytoLogix in a multicase patent dispute concerning slide-based cellular diagnostics, resulting in a $49 million recovery for CytoLogix. Ventana Medical Systems v. CytoLogix (D. Mass).

    • Served as co-lead trial counsel for ADT Corporation in a commercial dispute in Delaware Chancery Court resulting in an injunction barring the sale of Ring security products shortly before the holiday season and later a publicly disclosed multimillion-dollar settlement.     • Served as lead counsel for ADT Corporation in a patent infringement case regarding the patents of home security and automation systems. The case settled on favorable terms prior to the initial scheduling conference. Vringo Infrastructure, Inc. v. The ADT Corporation (S.D. Fla.).
    • Represented Fiberweb in a multinational patent dispute regarding nonwoven manufacturing and fabrics. We obtained favorable settlement on the heels of a successful Markman hearing. Fiberweb Simpsonville (and related entities) v. Baldwin Graphic Systems, Inc. (D. Del.).
    • Represented ChoiceStream in a patent matter involving online recommendation systems. We secured an outright dismissal with prejudice, without damages. ChoiceStream, Inc. v. Refined Recommendation, LLC (D.N.J.).

    • Served as lead counsel for Ocean Spray Cranberries, a beverage supplements and nutraceuticals company, in a patent infringement case securing summary judgment of non-infringement. Trivitis, Inc. v. Ocean Spray Cranberries, Inc. (S.D. Cal.).

    • Defended a group of major e-commerce companies in patent infringement cases related to e-commerce reviews and ratings technologies. Successfully resolved all cases on favorable terms.   • Manufacturing

    • Served as the lead trial counsel for WBIP, LLC, in a patent infringement case regarding the patents of low-carbon-monoxide-gasoline-electric-marine generators. The jury found the asserted patents willfully infringed and awarded our client $9.6 million in damages. The court found the case exceptional and awarded enhanced damages. WBIP, LLC v. Kohler Co. (D.   • ITC Litigation

    • Representing respondents Clarion Medical Technologies, Healthcare Markets, Inc. d/b/a Powered by MRP, and Luvo Medical Technologies in a patent-based Section 337 investigation concerning medical devices. The matter is ongoing. In the Matter of Certain Hydrodermabrasion Systems and Components Thereof III, Inv. No. 337-TA-1417.
    • Representing Cartessa Aesthetics as a respondent in a Section 337 investigation concerning medical devices. The complainant filed a petition in the ITC to halt the importation of the accused device, alleging infringement of the continuation of the patent that was dismissed at district court after we prevailed on summary judgment. In the Matter of Certain Hydrodermabrasion Systems and Components Thereof, Inv. No. 337-TA-1408.
    • Represented ADT in a patent-based Section 337 investigation concerning home security systems. In the Matter of Certain Residential Premises Security Monitoring and Automation Control Panels, and Components Thereof, Inv. No. 337-TA-1273.
    • Defended respondents AVer Information, IPEVO, and Lumens Integration in a patent-based Section 337 investigation concerning camera and digital-imaging technology.
