The Court of Federal Claims on Thursday awarded $34 million in damages to an Entergy-owned nuclear plant in upstate New York for damages and ongoing costs connected to Entergy’s storage of spent nuclear fuel. The company sued the federal government over its inability to fulfill contractual obligations to collect and store the plant’s nuclear waste due to political battles surrounding the acquisition of a long-term disposal site in Yucca, Nevada.

The $34 million awarded to Entergy covers storage, security and other costs for waste storage at two of their three reactors from 2008 through 2013. Entergy had originally asked for $35 million, but $879,000 of the claim was denied because it would have covered a 1999 regulatory fee increase that the court ruled was not foreseeable at the time of the contract breach.
