Alex Tomaszczuk, Pillsbury’s Government Contracts & Disputes Practice Group Co-Leader, is repeatedly recognized by Chambers USA as an authority on government contracts and disputes litigation.

Alex litigates high-dollar value government contract claims and bid protests, helps clients challenge adverse CPARS ratings and conducts internal investigations related to a wide range of compliance issues. He represents a diverse set of clients, including utilities, aerospace manufacturers, real estate developers and service contractors in actions before the GAO, the Court of Federal Claims and other federal forums. Alex has secured important victories in procurement and contractual disputes with the DOE, DOD, Justice Department, the GSA and other agencies.

Representative Experience

  • Served as trial counsel for a major aerospace manufacturer in its successful challenge to an adverse CPARS rating issued by the U.S. Air Force concerning a contract for engineering design and analysis of the landing gear for the F-15 aircraft.
  • Represented a publicly-traded REIT in connection with the negotiation of a number of financial and performance issues arising under a multi-year lease with the General Services Administration to house the new headquarters for the Transportation Security Agency in the Washington, DC metropolitan area.
  • Served as bid protest counsel in multiple proceedings challenging DHS’s decision to award and permit the performance of a $78 million contract to a client’s competitor, despite the client’s entitlement, under CICA, to an automatic suspension of the new award during bid protest proceedings.

  • Conducted many U.S. Court of Federal Claims trials and resultant Federal Circuit appeals related to the DOE's failure to pick up spent nuclear fuel, recovering hundreds of millions of dollars in damages for multiple utility clients.
  • Represented Boston Properties, Inc. in its successful challenge to GSA's multiyear, multimillion-dollar lease award for the new TSA headquarters in the Washington, DC, area, resulting in an unprecedented decision voiding the lease and reopening the competition.
  • Represented Entergy Corporation before the U.S. Court of Appeals for the Federal Circuit in a 2016 precedential decision allowing utilities to recover spent nuclear fuel cask-loading costs.
  • Managed internal investigation and reported to senior management of a leading research and development concern regarding allegations of time mischarging under U.S. government contracts and subcontracts.
  • Represented more than 20 utilities in litigation at the Court of Federal Claims and Federal Circuit involving the Department of Energy's overcharging of those utilities for uranium enrichment services.
  • Successfully litigated various bid protests at the GAO and Court of Federal Claims involving the real estate and government services industries.

  • Litigated precedent-setting breach of contract cases involving spent nuclear fuel disposal and major lease awards, and has been recognized by Chambers USA, Government Contracts – National (2009 – 2023).
  • Awarded the Charlie Flowers Corporate Partnership award in November 2015 by the International Community Corrections Association
