This session will provide an update on new employment law developments affecting nonprofit organizations. These developments include the NY SHIELD Act, which imposes cybersecurity and data privacy obligations on employers outside of New York that gather information on applicants who are NY residents; salary history bans and pay transparency laws; restrictions on consideration of applicants’ criminal conviction history; restrictions on imposing confidentiality and arbitration obligations on employees with harassment claims; gender identity protections and state recognition of nonbinary gender identification; enforcement of drug-free policies in jurisdictions that have decriminalized marijuana use; the evolution of digital accessibility requirements under the ADA, and new developments in classification requirements for exempt employees and independent contractors.
