The Small Business Administration (SBA) oversees a complex array of laws and regulations designed to prioritize the purchase of goods and services from small businesses. These laws and regulations implement the statutory goal of awarding 23% of all federal procurement dollars to small business concerns.
We draw on a deep bench and a wealth of experience to address the myriad small business procurement issues arising under SBA and Veterans Affairs programs. Our team includes a former co-chair and current vice-chair of the American Bar Association Public Contract Law Section’s small business programs committee.

We advise on issues in connection with 8(a) business development participants, service-disabled veteran-owned small businesses (SDVOSB), veteran-owned small businesses (VOSB), women-owned small businesses (WOSB), historically underutilized business zones (HUBZone), Alaska Native corporations (ANC), Native Hawaiian organizations (NHO) and the All Small Mentor-Protégé program.
We represent clients in small business size and status protests and appeals before the SBA Office of Hearings and Appeals (OHA) and North American Industry Classification System (NAICS) code appeals at OHA. We file bid protests before the Government Accountability Office (GAO) challenging set-aside contracts, bundling, and subcontracting plan issues.
We counsel clients regarding size eligibility and preferential status certification, size recertification on indefinite-delivery indefinite-quantity (IDIQ) contracts following mergers and acquisitions, affiliation issues, mentor protégé agreements, and formation of joint ventures. We advise clients concerning limitations on subcontracting, representations in the System for Award Management (SAM), and the small business innovation research (SBIR) and small business technology transfer (STTR) programs.
We advise clients on affiliation issues, including ownership, stock options and agreements to merge; common management; negative control; identity of interest; newly organized concerns; joint ventures; and ostensible subcontractors.
