A tenacious client advocate, Callie has successfully tried cases to verdict as lead counsel in both state and federal courts, as well as represented clients before the International Trade Commission. She litigates patent, trademark, trade secret, copyright, unfair competition and other bet-the-company disputes. Callie skillfully protects her clients’ IP rights in such diverse industries as medical devices, telecommunications, gaming, manufacturing, consumer products and hospitality.

Representative Experience

  • Representing MicroVention Inc. in a trade secret and breach of contract dispute in the Central District of California against Balt USA Inc. and former MicroVention executives in connection with the misappropriation and use of MicroVention trade secrets and other confidential information in the development of competing medical device products.
  • Representing MicroVention Inc. against Balt USA Inc. in a dispute in the Central District of California, asserting multiple patents related to MicroVention’s commercially successful V-Trak delivery system and V-Grip detachment controller used in the treatment of brain aneurysms.
  • Representing Viking Air Limited in a dispute with Ikhana Group LLC and Aevex Aerospace LLC in the Southern District of California involving claims for declaratory relief, breach of contract, misappropriation of trade secrets, trademark infringement and unfair competition. Successfully obtained a preliminary injunction on behalf of Viking Air.

  • Defended a health information technology company in a trade secret lawsuit involving the alleged theft of trade secrets pertaining to pharmaceutical benefits management services and claims adjudication data. Secured a favorable settlement on behalf of our client and the matter was subsequently dismissed.
  • Prevailed in a unanimous 10-day trial on behalf of San Diego Comic Convention in which a California federal jury found that a rival event in Utah infringed on our client's “Comic-Con” trademarks. Obtained an exceptional case finding and an award of nearly $4 million in attorney’s fees and costs.
  • Represented a website development company in a “David and Goliath” trade secret dispute against the world’s largest retail store. An Arkansas jury unanimously found that retailer to have willfully misappropriated trade secrets, awarding a damages verdict in excess of $12 million.
  • Achieved a complete defense victory on behalf of Intel in a patent case in the Western District of Texas on claims valued at over $150 million.
  • Led HM Electronics’ defense in two patent infringement cases in the Northern District of Texas involving restaurant pager technology. Won dismissal of both cases with prejudice after thwarting two preliminary injunction motions and obtaining successful claim construction rulings.
  • Represented HM Electronics in a trademark infringement and unfair competition case against R.F. Technologies, securing a permanent injunction, a finding of contempt and an award of nearly $1 million in court-ordered sanctions in favor of HM Electronics.
  • Represented the United Soccer League in a trademark dispute in the Central District of California with a rival soccer league.
  • Defended Mitsubishi Power Americas Inc. in a patent case filed against the company and its CEO in the Central District of California. Successfully obtained a dismissal of the lawsuit.
  • Obtained a permanent injunction for LG Electronics MobileComm upon discovering a former employee stole valuable trade secrets related to a new mobile phone product and shared them with a competitor.
  • Trial counsel for ZTE in dozens of district court actions involving claims of patent infringement pertaining to wireless handset devices.
  • Trial counsel for HTC in numerous district court actions involving claims of patent infringement pertaining to wireless handset devices.
  • Trial counsel for Eldorado Stone LLC and Eldorado Stone Operations LLC in a dispute with Renaissance Stone Inc. involving issues of trade secret misappropriation, copyright and trademark infringement and intentional interference with prospective economic relations. Three-week jury trial resulting in a verdict in favor of Eldorado Stone for in excess of $23 million in compensatory and punitive damages as well as injunctive relief, costs and attorneys' fees.
  • Lead counsel for Bazaar Del Mundo in a trademark dispute with the State of California over the Casa de Pico and Casa de Bandini trademarks. Successfully defended against a temporary restraining order and preliminary injunction, as well as an appeal to the Ninth Circuit Court of Appeals demanding the turn-over of Bazaar Del Mundo’s registered trademarks following the state’s termination of its concession agreement with Bazaar Del Mundo for Old Town State Historic Park. The case was dismissed, and our client continues its exclusive use of these trademarks.
  • Lead counsel for the San Diego County Apartment Association in a copyright dispute with the California Apartment Association over the copyrightability of apartment rental forms. Successfully opposed a temporary restraining order; case resolved shortly thereafter.
  • Lead counsel for Multimedia Games Inc. in a patent infringement action brought by International Gamco Inc. Responsible for defending the design, development and operation of the New York State Video Lottery System supporting multiple casinos and 14,000 video lottery terminals in the State of New York. Following six years of contentious litigation, the court granted summary judgment of non-infringement as to all claims.
  • Lead counsel for Multimedia Games Inc. in a patent infringement action filed by Aristocrat Technologies Australia Pty. Ltd. over the design and operation of the New York State Video Lottery System, as well as the video lottery systems designed and operated in numerous tribal casinos throughout Washington State. The case was resolved following a successful motion for summary judgment in favor of Multimedia Games.
  • Lead counsel for Robinson & Robinson Inc. and Leathertrend LLC in a dispute with Peterman Lumber Inc. involving claims for breach of contract, breach of implied warranties and violation of the Consumer Product Safety Act, resulting from the sale and delivery of lead-contaminated furniture legs. Two-week jury trial resulting in a multi-million-dollar verdict in favor of Robinson & Robinson and Leathertrend for past damages and future lost profits.
  • Representation of Jack In The Box® in a trademark dispute with its former master licensee for Mexico resulting in a multi-million-dollar verdict for Jack In The Box® as well as a permanent injunction.
  • Lead trial counsel in a 10-day jury trial for Andrea Karn in a personal injury dispute with Microsoft Corp. over injuries sustained during an event held by Microsoft. Obtained a significant jury verdict in favor of Ms. Karn.
  • Co-lead trial counsel for Kemper Insurance Company in an insurance bad faith action. Case dismissed during trial without payment by Kemper.
  • Participated as part of the trial team representing automobile manufacturers in numerous jury trials involving product liability and warranty claims.
  • Trial counsel in six misdemeanor jury trials for the San Diego District Attorney’s Office.
  • Lead counsel in over 30 arbitration hearings on behalf of automobile manufacturers and dealers involving product liability, warranty and unfair business practices claims.
