  • Represented energy company in first-of-its-kind workout and restructuring of $2 billion of D&O and fiduciary insurance for a multibillion-dollar merger-related securities class action. Settled litigation within policy limits.

    • Assisted Delek USA in recovering under fidelity policy losses incurred in cyberattacks and credit card information thefts at hundreds of MAPCO service stations.
    • Represented Arrowpoint Capital Corp. against Hartford Insurance regarding fidelity bond claims for $500 million loss suffered in a fraud case. District court denied opponent’s motions and granted all of ours.
    • Represented telecommunications provider in successful prosecution of its claims against its insurer confirming coverage for class action claims alleging cyber-related activities.
    • Represented one of the largest convenience store chains in the United States in recovery under crime policy for losses caused by hacking of customer data.
  • Employment Practices Liability
    • Obtained $6 million arbitration recovery for settled state wage and hour class action against a national fast food chain.
    • Achieved favorable settlement for client, a restaurant chain, following appellate victory in case seeking reimbursement for wage and hour class action settlement costs.
    • Representing medical clinic on claims for an underlying employee wage action. After initial coverage denial, obtained complete defense and substantial indemnity payment toward settlement of the underlying lawsuit.
    • Challenged insurer’s failure to defend and indemnify power equipment manufacturer for alleged liability in an employment practices suit. Involved manuscript employment practices liability coverage endorsement, which is novel in London’s insurance market.
    • Represent client in lawsuit seeking coverage under staffing services professional liability policy for denied claim on settlement of wage and hour class action.
    • Act as trial counsel for government contractor in $20 million employee theft claim.
    • Represented acquirer of private information technology company in dispute under representation and warranty policy.
    • Negotiating representation and warranty insurance policies, including use of Pillsbury’s proprietary policy wording, in connection with scores of transactions.
