Representative Experience

Acted for an affiliate of Boston Properties in a bid protest challenging the award of a lease for the new headquarters of TSA in Washington, DC. Protest upheld and lease voided.

Represented Parsons Corp. in obtaining dismissal with prejudice on statute of limitations grounds of an FCA qui tam lawsuit alleging that an Iraq contractor and subcontractor had engaged in kickback schemes.

Served as regulatory counsel to private equity firm Veritas Capital in several recent acquisitions, including Abaco Systems from GE and StandardAero from Dubai Aerospace, and in sales of Truven Health and CRGT.

  • Bid Protests
    • Handled successful GAO protest of a $37 million award of an Army information technology contract, challenging attribution of past performance among corporate affiliates, staffing evaluation, and disparate treatment of proposals.
    • Successfully defended Ernst & Young in competitors’ bid protests at GAO and the Court of Federal Claims, which ruled that EY had no organizational conflict of interest and was eligible for an Army contract
    • Represent Dismas Charities as intervenor in bid protests and state court proceedings challenging contract awards to Dismas for halfway house services. Favorable decisions were issued in all proceedings.
    • Handled successful GAO protest of $66 million award for a Navy information technology contract, which established new GAO case law concerning requirement for consistency between agency evaluations for the same acquisition.
    • Represented client in successful GAO protest of a $15 million award for a NASA Human Resources Integrated Professional Services contract, which challenged past performance evaluation for a joint venture.
    • Represented Paragon Technology in a successful GAO bid protest hearing that sustained our client’s protest on grounds of DoD’s misleading discussions and improper past performance evaluation in a program management acquisition.
    • Filed four protests for Raymond Express International with Defense Commissary Agency, GAO, and Court of Federal Claims challenging solicitation terms for produce for commissary stores overseas.
  • Claims and Litigation
    • Conducted numerous trials and argued several lead cases at the Federal Circuit for nuclear utilities seeking to recover damages resulting from the government’s failure to dispose of spent nuclear fuel.
    • Served as lead counsel for Boston Properties Inc. affiliate in case filed at Civilian Board of Contract Appeals. Case settled with Boston Properties recovering $316,000+ for operating cost adjustments.
    • Served as co-lead counsel in defending a Department of Justice False Claims Act investigation of ASES Inc. regarding alleged faulty overhaul work on aircraft engines.
    • Settled Northern States Power’s (NSP) initial spent nuclear fuel claim for more than $100 million, among largest single settlements ever paid by government, and handling annual, follow-on settlement claims.
    • Served as lead trial lawyer in federal district court FTCA case. Awaiting trial on damages after winning on the issue of the United States’ liability for damages.
  • Costs/Cost Accounting Standards and Truthful Cost or Pricing Data Act
    • Won dismissal of government’s $1.8 million claim against the company alleging unallowable indirect costs and penalties.
  • Counseling
    • Represented one of the world’s largest aircraft manufacturers in all phases of a U.S. Air Force competitive procurement, and then though performance of the contract, for the production of fighter jets sold under the Foreign Military Sales program.
  • Compliance Matters
    • Assisted Front Porch Corp. in obtaining facility waivers and stopping administrative proceedings by the Department of Labor related to affirmative action plan requirements.
  • Mergers & Acquisitions
    • Represented private equity firm Liberty Hall Capital and Accurus Aerospace as regulatory counsel in the acquisition of six recent aerospace parts manufacturers, including AIM Aerospace and Bromford Industries.
  • Subcontracting and Teaming
    • Obtained dismissal with prejudice for Lockheed Martin in a federal district court matter by a plaintiff packaging manufacturer alleging it was a third-party beneficiary of a federal government contract.
  • Suspension and Debarment
    • Successfully represented client in proposed debarment matter before U.S. Army. Action was based on public SEC findings that he violated the Foreign Corrupt Practices Act (FCPA).
    • Prevailed for IXI Technology in suspension matter before U.S. Navy and negotiated administrative agreement enabling company to restore its eligibility and continue obtaining government contracts.
    • Successfully represented former president of FedBid proposed debarment matter with the U.S. Air Force.
    • Achieved favorable resolution for AQuate Corporation and its former president in proposed debarment matter with the U.S. Army.
    • Prevailed Kamlesh Patel, owner and former president of J&J Contractors Inc., in suspension matter before the Small Business Administration.
