Donald Trump’s cabinet picks begin their confirmation hearings this week, leading to more speculation about the effect the President-Elect and a Republican-held Congress will have on the legacies of the Obama administration. According to Law360, Tom Wheeler, chairman of the Federal Communications Commission, is among the people whose legacies may struggle to remain intact with the Republican Party controlling both the executive and legislative branches.

Washington, DC Communications partner Glenn Richards told Law360 that while Republicans have pushed for legislation in the past, it is unclear whether they will continue to pursue that or if they would be content with a new direction for the FCC.

“The question is: can they really muster the efforts?” he said. “Plus, you know the [Democrats] will have input despite the fact that the [Republicans] hold the Congress.”

Richards noted that the GOP would have more success with changing past FCC action through legislation since that would come with a smaller threat of being overturned by the courts.
